Small Claims Court Info

Do we still have Small Claims court in Saint John? If so what is the process to sue someone? How much does it cost to file a claim?

Any info would be apprececiated.

Small claims court was effectively gutted as another gift (?!) to the poor by Shawn Graham last year. IMHO it is of no further use to anyone - it's the same as regular court.
You should really get the info from the horses mouth however, call or visit the courthouse. It may still be useful to you.

I was just talking to Consumer Affairs she said there is indeed a Small Claims court and the amounts have increased that your allowed to go for. Thank goodness you had me worried.

In theory the ideal of small claims court is great. In reality small claims court does not work.(unless you are suing a company) If someone owes you money and does not pay up, filing a small claims suit doesn't mean you will walk out of court with cash in hand. Personally, I think it's a waste of time and money (your own filing fee) to bring a personal suit to small claims. Consider the issue a life lesson, and a mistake you won't make again. jmo

Small claims worked for me yrs ago. I won easily, bonehead appealed with no new evidence. He was scolded severely by the judge for appeal but still refused to pay. I was told by the court to get an order of search and seizure (there is a fee, the sheriff goes to their home or place of business and seizes something of value to sell). The fee is recoverable from the sale of the seized goods also so it doesn't cost any extra.
I threatened bonehead for about a month with seizure (why was I so patient?) and he finally paid.
That being said, I don't think this new form of small claims is going to work at all for the reasons given above.

The way I read it.....he was calling the person he was in court with the "bonehead", as he states (the) bonehead appealed......I take that to be the other person...not you......wow....LOL
