apartment leases Question...

Good morning,
I am wondering if anyone may have been in this situation, and may have any information.
My daughter is in a one year lease until August,however she is pregnant and would like to come back to Saint John in May as she is due the first of August.
Is there any way of breaking a lease early due to her circumstances.
Any info would be greatly appreciated.

She needs to set up an appointment with her landlord explain the situation, draw up an agreement that if the landlord can get a tenant to replace her with out losing any money then see if she can get out of it. Sometimes if you sweeten the pot a little it may help, like paying an extra months rent once she leaves.This way the landord could possible make double the rent in 1 month

Unfortunatley the ball is in the landlord court, so she wants to be as nice and flexible as possible, otherwise, she may end up having to pay the rent right until August.

If they do agree on the extra months rent or some other deal, PLEASE PLEASE get it in writing.

Chinna is right to some degree... your daughter, not the landlord, can either find another tenant to take over the remainder of the lease, or she can sublet it to someone else. The responsibility to mitigate any loses would be up to your daughter. She would have to make sure though that there is no clause in her lease agreement that prevents her from subletting the apartment.

Her landlord said she could sublet it,however he has it rented for August 1st.I am thinking it would be difficult for her to rent it out for 2 months.Her lease is from May 15th 2009 through to August 15th 2010( it appears to be a 15 month lease)

Her lease is until August 15th, but he has someone renting it from August 1st.... doesn't make sense to me. Does that not violate the lease agreement in itself?

It is really confusing to me as well,I guess it is being further looked into now.So all we can do is cross our fingers ...and hope that the baby can be born here.

I agree, the landlord has already broken the lease agree by renting it for Aug 1 if her lease is until Aug 15. What would he have done had your daughter stayed right till the 15th? Sound out of sorts to me.
